Legislative rules

Interpretive rules are exempt from the APA’s notice-and-comment requirements because they clarify how a statute or existing rule should be understood rather than creating new rights or obligations. The APA’s rulemaking protections are aimed at those actions that bind people in new ways or impose new duties. When an agency is simply interpreting a statute or its own prior rule, it isn’t imposing fresh policy through formal rulemaking, so it bypasses the usual notice-and-comment process.

In contrast, actions that actually create or modify rights or duties—legislative (substantive) rules—do require notice and comment and thus are not exempt.
